The web application Menue-Lounge operated by Hofmann Menü-Manufaktur GmbH, Adelbert-Hofmann-Str. 6, 97944 Boxberg-Schweigern (hereinafter referred to as Menü-Manufaktur) serves the simple and efficient management of a company canteen or cafeteria and is provided to the operator - hereinafter also referred to as customer.
The customer and the Menü-Manufacture pursue the common goal of achieving a high acceptance on the part of the table guests for the company canteen or refectory.
What happens here?
The web application Menue-Lounge serves the simple participation in the catering with regard to ordering, processing and billing and for information around the catering.
You are offered in Menue-Lounge the menüs available at your employer / educational institution to order. You can cancel or change them free of charge until the specified time. Menue-Lounge collects the orders of the table guests and creates from it for the administrative personnel preparation, issue and account lists.
The central component here is the "virtual canteen worker Hanna" ("Hanna"), which appears in many respects as a helper with the supply of the food and the communication with you in the name of your employer / your educational institution. She sends the lists and contacts you as a table guest, for example, to inform you that an item you requested is available. Hanna also randomly asks about your satisfaction and you have the opportunity to criticize, praise and suggestions anonymously and voluntarily to äußern.
What data is required?
Menue-Lounge benötigtigt your mail address, title, first name, last name and your personnel number to function properly.
The e-mail address is used to contact you, for example, to inform you as soon as a menu marked by you as "desired dish" becomes available or in case you have forgotten your password. You can object to the contact in your profile.
First name, first name and last name will be used for the menu output. Here, the issuing staff needs a list of which table guest ordered which item.
The personnel number is required for billing by your personnel department.
If you object in your profile to being contacted, you will only receive mails requested by you to change your password. All other mails ("Desired dish is there", "Have-I-ordered-today reminder mail", promotions, etc.) will only be sent to you again if you agree to be contacted again.
Additionally, we process the following data from your device, which may also be classified as personal data: device model, CPU architecture, amount of installed memory (RAM), amount of available storage space, operating system version, and the device's jailbreak/root status.
How is the data used?
Your data will be used by the operator of the company restaurant / canteen for the smooth operation of your company restaurant / canteen. This includes, in addition to your contact details, the collected orders.
In addition, Hofmann Menü-Manufaktur GmbH evaluates ordering behavior, menüpräferences and use of the software in anonymous form in order to further develop our software and our range of products. You can object to this procedure in your profile, but then you will no longer receive any menu recommendations.
We process your device data to detect app crashes, resolve issues more quickly, analyze the causes of malfunctions, and improve the stability and performance of the mobile app.
How do we handle the protection of your data?
The protection of your personal data is important to us; we therefore protect it from unauthorized access or use and only use it within the framework of the following regulations:
1. Hofmann Menü-Manufaktur GmbH protects your personal data by taking all reasonable and necessary technical and organizational measures so that they are not accessible to unauthorized third parties. The web application and the other services offered via it therefore use appropriate encryption mechanisms for the provision of content and during the input and transmission of data.
2. The person responsible for the operation of the web application within the meaning of Article 4 (7) of the EU General Data Protection Regulation (GDPR) is the operator of the company restaurant/cafeteria. You can contact the data protection officer of your mployer/your educational institution, whose contact details you can obtain from your HR department/secretariat. 3. If you send e-mail messages or other communications to us or enter them directly in the web application, we retain such communications in order to process the request, respond to questions, and carry out the contractual relationship with your employer/educational institution on which the provision of catering to you is based. We delete the data accruing in this context, after the storage is no longer necessary, or restrict the processing, if there are legal storage obligations.
4. A use and / or Übermittung of your personal data is only,
- in the context of your above-given, express consent (gemäß Art. 6 para. 1 p. 1 a) (DSGVO) to your employer / educational institution to carry out the catering and to our technical service provider to enable the above-described communication with you;
- if the transfer is necessary for the performance of contractual obligations gemäß Art. 6 para. 1 p. 1 b) DSGVO is required, such as in the context of billing for catering with your employer / educational institution;
- if we are legally obliged to disclose the data in the sense of Art. 6 para. 1 p. 1 c) DSGVO;
- if the disclosure of data is in the public interest in the sense of Art. 6 para. 1 e) DSGVO or;
- if the disclosure of data under Art. 6 para. 1 p. 1 f) DSGVO is necessary to protect our legitimate interests or the legitimate interests of a third party, unless your interests in the protection of your data üoverride, in which case we anonymize the data available to us, for example, in the context of a statistical analysis so that a direct link to your person is no longer possible.
5. You have the right at any time to inquire free of charge üabout the data collected about your person. You also have the right at any time to revoke your consent to the use of your personal data with effect for the future (directly in your profile under settings possible) and to request correction or deletion of the data stored by us. In particular, you have the following rights with respect to your employer/educational institution regarding the personal data concerning you:
- Right to information,
- Right to correction or deletion,
- Right to restriction of processing,
- Right to object to processing,
- Right to data portability.
You also have the right to complain to a data protection supervisory authority ürde about the processing of your personal data by the operator. In detail, you have the following data subject rights:
a) Right to information pursuant to Art. 15 DSGVO about the processing of your personal data by us on the purpose of processing, categories of data processed, recipients or categories of recipients, duration of storage or criteria for determining the duration, right to rectification, deletion, restriction of processing or objection to processing, right to lodge a complaint with the supervisory authority, if applicable. Information on the origin of the data and the existence of automated decision-making and, where applicable, information on guarantees pursuant to Art. 46 DSGVO in the event of transfer to a third country or international organizations;
b) Right to immediate rectification of inaccurate or completion of incomplete personal data pursuant to Art. 16 DSGVO;
c) Right to erasure of stored personal data pursuant to Art. 17 DSGVO, if the data is no longer necessary for the purposes for which it was collected or otherwise processed, if consent has been revoked and there is no other legal basis, if objection to processing has been lodged and the data has been deleted pursuant to Art. 21 (1) or (2) DSGVO may no longer be processed, if the data was processed unlawfully, if the data processing is necessary to fulfill a legal obligation or if the data was collected in relation to services offered by an information society pursuant to Art. 8 (1) DSGVO. This does not apply if the processing is necessary for the exercise of the right to freedom of opinion and information, the fulfillment of a legal obligation, for reasons of public interest or for the assertion, exercise or defense of legal claims;
d) Right to restrict processing pursuant to Art. 18 DSGVO, if you dispute the accuracy of the data (for the period of time necessary to verify the accuracy), if the processing is unlawful, but you object to the deletion and request the restriction of the use instead; You may request the restriction of use if we no longer need the data for the purposes of processing but you need the data to assert, exercise or defend legal claims, or if you object to the processing pursuant to Art. 21 para. 1 DSGVO, as long as it has not yet been determined whether our legitimate reasons outweigh your legitimate reasons;
e) Right to object to the processing of your personal data pursuant to Art. 21 para. 2 DSGVO (if the data are processed for the purpose of direct marketing) or pursuant to Art. 21 para. 1 DSGVO (if the processing is carried out pursuant to Art. 6 para. 1 sentence. 1 e) or f) DSGVO, for reasons arising from your particular situation, unless we have compelling legitimate grounds for the processing which override your interests, or the processing serves the purpose of asserting, exercising or defending legal claims).
f) Right to data portability pursuant to Art. 20 DSGVO, i.e. to receive the personal data concerning you that you have provided to us in a structured, valid and machine-readable format or also to transfer to another person responsible;
g) Right to revoke consent given at any time pursuant to Art. 7 para. 3 DSGVO. The revocation has the consequence that we may no longer carry out the data processing for the future from the time of the revocation.
h) Right to lodge a complaint with a supervisory authority pursuant to Article 77 of the GDPR. The right of appeal is without prejudice to other administrative or judicial remedies. i) For the provision of information and for revocation as well as for the notification of a request for data protection, please contact the data protection officer of your employer/your educational institution, whose contact details you can obtain from your personnel department/secretariat. They will then provide the information without delay or confirm the execution of your request for information. Any data requested by you will then be stored subject to statutory storage obligations. If a data collection cannot be carried out completely due to legal storage obligations, we will restrict the processing and inform you accordingly. Insofar as you contact Hofmann Menü-Manufaktur, we will forward your request to your employer/educational institution.
